This Privacy Policy is published in compliance with the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 ("SPDI Rules"), and is aligned with the Digital Personal Data Protection Act, 2023 ("DPDPA"). By accessing or using ZODIAQ, you acknowledge and accept this Policy. If you do not agree, please discontinue use immediately.

Applicable Indian Law

This Policy is published pursuant to Rule 4 of the SPDI Rules, 2011 (under the IT Act, 2000), and is aligned with obligations under the Digital Personal Data Protection Act, 2023 (DPDPA). References to "Data Principal" and "Data Fiduciary" reflect DPDPA terminology, where ZODIAQ acts as the Data Fiduciary.

1. About ZODIAQ and This Policy

ZODIAQ is an online astrology marketplace operated by [ZODIAQ TECHNOLOGY PRIVATE LIMITED], a company incorporated under the Companies Act, 2013, with its registered office at [Registered Address, India]. ZODIAQ connects users seeking personalised astrological guidance with verified professional astrologers for live 30-minute consultation sessions conducted through the platform.

The platform also leverages Artificial Intelligence ("AI") to generate astrological predictions from birth data to assist astrologers in delivering more accurate consultations. Payments are facilitated through Razorpay, a licensed Payment Aggregator regulated by the Reserve Bank of India (RBI).

This Policy governs the collection, storage, use, sharing, and protection of Personal Information and Sensitive Personal Data or Information ("SPDI") provided by users and astrologers on the ZODIAQ platform. It is to be read in conjunction with our Terms and Conditions.

2. Key Definitions

For the purposes of this Policy, the following terms shall have the meanings assigned below:

  • Personal Information: Any information that can be used to identify you, such as name, email, phone number, or device identifier.
  • Sensitive Personal Data or Information (SPDI): As defined under SPDI Rules, 2011 — includes passwords, financial information, physical/mental health data, biometric data, and information collected in confidence. Birth details (date, time, place) as used for astrological profiling, and financial account information, are treated as SPDI on this platform.
  • Data Fiduciary: ZODIAQ — the entity that determines the purpose and means of processing personal data.
  • Data Principal: You — the individual whose personal data is being processed.
  • Consent Manager: A mechanism under DPDPA through which consent is recorded and can be managed or revoked.
  • AI Prediction Engine: ZODIAQ's proprietary artificial intelligence system that processes birth data to generate astrological analysis for use by astrologers during consultations.
  • Razorpay: Razorpay Software Private Limited, a third-party Payment Aggregator licensed by the Reserve Bank of India, engaged by ZODIAQ to process all in-app financial transactions.

AI Processing of Birth Data

ZODIAQ uses an AI Prediction Engine to process your birth details and generate astrological predictions. These AI-generated insights are shared exclusively with your chosen astrologer to assist them during your consultation. Your birth data is not shared with any external AI provider. The AI model operates on ZODIAQ's own infrastructure. AI-generated predictions are intended as decision-support tools for astrologers and do not constitute guaranteed forecasts. Please see Section 6 for full details.

3. User Consent

In accordance with the DPDPA, 2023, and the SPDI Rules, 2011, ZODIAQ obtains free, specific, informed, and unambiguous consent from Data Principals before collecting and processing their Personal Information and SPDI.

By registering on and using ZODIAQ, you:

  • Confirm you have read and understood this Privacy Policy;
  • Provide explicit consent to the collection, use, and processing of your personal data for the purposes described herein;
  • Specifically consent to the processing of your birth details through ZODIAQ's AI Prediction Engine for the purpose of generating astrological insights to assist your astrologer;
  • Consent to the recording of live consultation sessions for safety and dispute resolution purposes;
  • Acknowledge that certain features of ZODIAQ require the provision of SPDI and cannot function without it.

You have the right to withdraw consent at any time by contacting us at privacy@zodiaq.app. Withdrawal of consent may result in partial or complete unavailability of the platform's services.

4. Information We Collect

4.1 From Users (Data Principals Seeking Consultations)

Account & Identity Information

  • Full name, email address, and mobile number (required for account registration).
  • Profile photograph (optional).
  • Gender and date of birth (for account and personalisation purposes).

Birth Details — Collected as SPDI

The following birth details are collected and treated as Sensitive Personal Data or Information under the SPDI Rules, 2011 and DPDPA, 2023:

  • Date of birth
  • Time of birth (if known)
  • Place of birth (city, state, and country)

Birth details are used for two purposes: (a) to power the AI Prediction Engine which generates personalised astrological insights for your astrologer before and during your consultation, and (b) to provide free astrological features such as birth chart generation, horoscope readings, and compatibility tools available on the platform.

Consultation Content & Session Recordings

All consultation sessions conducted over the ZODIAQ platform are recorded. These recordings may include any personal information — including sensitive personal matters — voluntarily disclosed by you or the astrologer during the call. Please note the following regarding recordings:

  • Recordings are stored on secure, encrypted servers.
  • They are not available for playback by the user, astrologer, or any ZODIAQ staff under normal circumstances.
  • Recordings are accessed only by authorised ZODIAQ personnel in the event of a formally raised complaint involving abuse, misconduct, harassment, fraud, or breach of platform guidelines.
  • Recordings are not used for training AI models, marketing, or any commercial purpose whatsoever.
  • By initiating a consultation, both the user and the astrologer consent to the recording of that session.

Transaction & Wallet Information

  • Wallet top-up amounts, wallet balance, and transaction history.
  • Booking records, cancellation records, and refund histories.
  • Payment transaction data processed through Razorpay. ZODIAQ does not collect, store, or retain card numbers, CVVs, UPI PINs, or any other payment instrument credentials. These are processed directly and securely by Razorpay. See Section 7.

4.2 From Astrologers

Professional Profile Information

  • Full name, date of birth, and age (for identity verification and profile display).
  • Profile photograph and professional biography.
  • Years of experience and areas of expertise.
  • Government-issued photo identification (Aadhaar, PAN, or Passport — for KYC and onboarding compliance).
  • Consultation pricing and availability schedule.

Bank Account Details — Collected as SPDI

To process consultation earnings, astrologers are required to provide:

  • Bank account holder name.
  • Bank account number and IFSC code.
  • UPI ID or other digital payment identifiers (where applicable).
  • PAN number (for compliance with Indian income tax regulations).

This financial information is classified as SPDI and is stored with AES-256 encryption. Access is restricted to authorised ZODIAQ finance personnel and our payment processing partner, Razorpay, strictly for the purpose of disbursing earnings.

4.3 Technical & Device Data

When you use the ZODIAQ platform (app or website), we automatically collect:

  • Device type, operating system, and browser.
  • IP address and approximate geographic location.
  • App usage data, feature interactions, and session duration.
  • Crash logs and diagnostic information.
  • Referral URL and timestamps.

4.4 Microphone & Audio Permissions

Live consultation calls require access to your device's microphone. ZODIAQ requests this permission solely to enable voice communication during the consultation. Audio data from calls is processed to enable the live session and is recorded for the safety purposes described above. It is not shared with third parties and is not used for advertising or AI model training.

Transparency Notice: Automated Processing of Personal Data

This section is required under the Digital Personal Data Protection Act, 2023 and reflects principles of algorithmic transparency. The AI Prediction Engine constitutes automated processing of Sensitive Personal Data (birth details). ZODIAQ ensures that this processing is disclosed clearly and that astrologers remain responsible for all final advice given to users.

5. How and Why We Use Your Information

ZODIAQ processes Personal Information and SPDI for the following lawful purposes:

5.1 Service Delivery

  • Creating and managing user and astrologer accounts.
  • Facilitating the browsing of astrologer profiles and the booking of consultations.
  • Processing wallet top-ups, booking deductions, and cancellation refunds.
  • Disbursing consultation fees to astrologers upon session completion.
  • Providing free astrological features (birth chart, horoscope, etc.) using birth details.

5.2 AI-Assisted Consultation Enhancement

Birth details provided by users are processed through ZODIAQ's AI Prediction Engine. This generates structured astrological predictions and analysis that are made available to the user's chosen astrologer before and during the consultation. The purpose of this processing is to improve the accuracy and quality of astrological guidance received by the user. See Section 6 for the complete AI processing disclosure.

5.3 Safety, Trust & Dispute Resolution

  • Retaining consultation recordings to investigate formal complaints of abuse, misconduct, or fraud.
  • Monitoring the platform for policy violations, fraudulent wallet activity, and unauthorised access.
  • Verifying astrologer credentials and qualifications during onboarding.

5.4 Communication & Notifications

  • Sending booking confirmations, reminders, and transaction receipts via SMS, email, or in-app notification.
  • Responding to customer support queries and complaints.
  • Sending platform updates, policy changes, and promotional offers (you may opt out of marketing communications at any time).

5.5 Legal & Regulatory Compliance

  • Complying with the IT Act, 2000, SPDI Rules, 2011, DPDPA, 2023, Prevention of Money Laundering Act (PMLA), and applicable RBI directives.
  • Responding to lawful requests from Indian courts, tribunals, law enforcement, or regulatory authorities.
  • Maintaining financial records as required under the Companies Act, 2013 and Income Tax Act, 1961.

5.6 Platform Improvement & Analytics

  • Analysing anonymised, aggregated usage patterns to improve app features and user experience.
  • Conducting internal research. No individual personal data is used for external research without explicit consent.

6. AI Prediction Engine — Full Disclosure

ZODIAQ's AI Prediction Engine is a proprietary algorithmic system that processes a user's birth details (date, time, and place of birth) to generate structured astrological charts, planetary positions, dasha timelines, and predictive insights.

6.1 How It Works

  • Input: The user's birth details (date, time, place) are submitted to the AI Prediction Engine when the user creates their profile or books a consultation.
  • Processing: The engine performs astrological computations and applies pattern-based AI models trained on astrological datasets to generate predictions across domains such as career, relationships, health, and finance.
  • Output: A structured prediction report is generated and made available exclusively to the astrologer booked by the user, prior to and during the consultation.
  • Astrologer Use: The astrologer uses this AI-generated report as a reference tool to augment their own expertise. The astrologer remains fully responsible for the advice they provide.

6.2 Data Governance for AI Processing

  • Birth data processed by the AI Prediction Engine is never shared with external AI service providers or third-party machine learning platforms.
  • The AI model runs on ZODIAQ's own secured infrastructure.
  • AI-generated outputs are not sold, licensed, or disclosed to any third party.
  • User birth data is not used to train, update, or improve the AI model without explicit, separate consent.
  • AI predictions are generated on an individual basis and are not aggregated or combined with other users' data to build profiling databases.

6.3 Limitations & Disclaimer

AI-generated astrological predictions are provided as decision-support tools for astrologers and are not guarantees of future events. ZODIAQ makes no warranty as to the accuracy of AI-generated predictions. Users are advised that astrological guidance is of an advisory nature only and should not be treated as professional advice in medical, legal, or financial matters.

7. Payments and Razorpay Integration

All financial transactions on ZODIAQ — including wallet top-ups, booking payments, cancellation refunds, and astrologer disbursements — are processed by Razorpay Software Private Limited ("Razorpay"), a Payment Aggregator licensed and regulated by the Reserve Bank of India under the Payment and Settlement Systems Act, 2007.

No Card or Payment Credential Storage

ZODIAQ does not collect, process, store, or retain any payment instrument credentials. This includes credit/debit card numbers, CVV codes, card expiry dates, UPI PINs, net banking credentials, or one-time passwords (OTPs). All such data is entered directly on Razorpay's PCI-DSS compliant checkout interface and is governed solely by Razorpay's Privacy Policy.

7.1 What ZODIAQ Does NOT Store

ZODIAQ does not collect, process, store, or retain any payment instrument credentials including credit/debit card numbers, CVV codes, UPI PINs, net banking credentials, or OTPs. All such data is handled solely by Razorpay.

7.2 What ZODIAQ Records

  • Transaction reference IDs generated by Razorpay.
  • Wallet top-up amounts and timestamps.
  • Booking amounts, refund amounts, and astrologer payout records.
  • Payment status (success / failure / pending).

These records are maintained for accounting, tax compliance, and dispute resolution purposes.

7.3 Razorpay's Data Practices

By initiating a payment through ZODIAQ, you acknowledge that your transaction data will be processed by Razorpay in accordance with its own Privacy Policy, available at razorpay.com/privacy. Razorpay complies with RBI guidelines on data localisation, requiring that all Indian payment data be stored within India. ZODIAQ is not responsible for Razorpay's data practices.

Razorpay may tokenise your payment information in accordance with RBI tokenisation guidelines, eliminating the need for your card credentials to be stored by any merchant.

8. Legal Basis for Processing

Under the DPDPA, 2023, and SPDI Rules, 2011, ZODIAQ processes your data on the following legal grounds:

9. Disclosure and Sharing of Your Information

ZODIAQ does not sell, rent, or trade your personal information to third parties. Your information is disclosed only in the following circumstances:

9.1 With the Booked Astrologer

When a consultation is booked, the astrologer receives: (a) your first name, (b) your birth details, and (c) the AI-generated prediction report based on your birth details. No contact information, payment details, or additional personal information is shared with astrologers.

9.2 With Razorpay (Payment Processing)

Transaction-specific data is shared with Razorpay to process wallet top-ups and astrologer disbursements. Razorpay handles all payment credential data independently under its own privacy policy and RBI-compliant data security framework.

9.3 With Cloud & Technology Service Providers

ZODIAQ engages reputable third-party cloud infrastructure, analytics, and communication service providers. These providers process data only as instructed by ZODIAQ, under contractual data processing agreements that prohibit unauthorised use or disclosure.

9.4 For Legal & Regulatory Compliance

ZODIAQ may disclose user data to Indian government authorities, courts, tribunals, or law enforcement agencies where required under the IT Act, 2000; DPDPA, 2023; PMLA, 2002; or other applicable statutes. We will notify affected users of such disclosures to the extent permitted by law.

9.5 Consultation Recordings — Restricted Disclosure

Consultation recordings will not be disclosed to any party under any normal circumstance. In the event of a formal complaint, recordings may be reviewed by authorised ZODIAQ personnel only to the extent necessary to investigate the specific complaint. Recordings are never disclosed to the astrologer, the user, or any third party as part of complaint proceedings.

9.6 Business Transfers

In the event of a merger, acquisition, restructuring, or sale of ZODIAQ's business assets, personal data held by ZODIAQ may be transferred to the acquiring entity. Users will be notified via email and/or in-app notification prior to such transfer, with the option to request deletion of their data.

10. Data Retention

ZODIAQ retains personal data only as long as necessary for the purposes described in this Policy or as required by applicable Indian law:

Data Breach Notification

In the event of a personal data breach that poses a risk to your rights and freedoms, ZODIAQ will notify you and the relevant authority (as required under DPDPA, 2023) within the timeframe prescribed by law. Notifications will be sent to your registered email address and/or via in-app alerts.

11. Data Security

ZODIAQ implements technical and organisational measures that meet the "reasonable security practices" standard prescribed under Section 43A of the IT Act, 2000, and Rule 8 of the SPDI Rules, 2011, including conformance with IS/ISO/IEC 27001 information security management standards (or equivalent):

  • AES-256 encryption at rest for all SPDI including birth details and bank account data.
  • TLS 1.2/1.3 encryption in transit for all API communications and consultation session data.
  • End-to-end encrypted consultation call infrastructure.
  • Role-based access controls with least-privilege principles for all ZODIAQ personnel.
  • Multi-factor authentication for all internal systems.
  • Regular security audits, penetration testing, and vulnerability assessments.
  • Consultation recordings stored on isolated, access-controlled servers, separate from general platform infrastructure.

12. Your Rights as a Data Principal

Under the Digital Personal Data Protection Act, 2023, and the SPDI Rules, 2011, you have the following rights with respect to your personal data. To exercise any right, contact our Grievance Officer (Section 14).

12.1 Right to Access (Section 11, DPDPA)

You may request a summary of the personal data we hold about you and the purposes for which it is processed. We will respond within 30 days.

12.2 Right to Correction and Erasure (Section 12, DPDPA)

You may request correction of inaccurate or incomplete data, and deletion of data that is no longer necessary or for which consent has been withdrawn. Upon valid deletion requests, we will erase or anonymise your data, subject to retention obligations under applicable law.

12.3 Right to Withdraw Consent (Section 6, DPDPA)

You may withdraw consent for the processing of SPDI at any time. Withdrawal will be actioned within 30 days. Please note that withdrawal of consent for core data (e.g., birth details) will result in the inability to use consultation and astrological features.

12.4 Right to Nominate (Section 14, DPDPA)

In the event of your death or incapacity, you may nominate an individual to exercise your data rights on your behalf.

12.5 Right to Grievance Redressal (Section 13, DPDPA)

You have the right to have your complaints addressed by ZODIAQ's Grievance Officer within the timeframe specified. If unresolved, you may escalate to the Data Protection Board of India established under the DPDPA.

12.6 Right to Non-Discrimination

ZODIAQ will not discriminate against you for exercising any of your privacy rights, including by denying services, charging different prices, or providing inferior service quality.

13. Children's Privacy

ZODIAQ is not intended for use by individuals below the age of 18 years. In compliance with the DPDPA, 2023, ZODIAQ does not knowingly process personal data of children without verifiable parental consent.

If we become aware that an account has been created by or for a person under 18 years of age without appropriate consent, we will immediately suspend the account and delete all associated data. If you believe a minor has registered on the platform, please contact privacy@zodiaq.app immediately.

Astrologers are also prohibited from engaging in consultations with users who are minors.

14. Grievance Officer & Contact Details

In accordance with Rule 5(9) of the SPDI Rules, 2011, and Section 13 of the DPDPA, 2023, ZODIAQ has designated a Grievance Officer to address complaints and queries related to this Privacy Policy:

15. Cookies and Tracking Technologies

ZODIAQ uses cookies and similar technologies on its website and app to improve user experience and gather analytics:

  • Essential Cookies: Required for session management, security, and platform functionality. Cannot be disabled without affecting service availability.
  • Analytics Cookies: Used to understand feature usage, traffic patterns, and app performance (e.g., Firebase Analytics). Data is anonymised.
  • Preference Cookies: Store your language, region, and UI preferences.

You may manage cookie preferences through your device or browser settings. Disabling non-essential cookies will not affect your ability to use core platform features.

16. Third-Party Links and Platforms

ZODIAQ may contain links to third-party websites, social media pages, or external services. ZODIAQ is not responsible for the privacy practices or content of such third parties. We encourage you to review the privacy policies of any third-party platforms before providing personal information to them.

17. Cross-Border Data Transfers

Pursuant to the DPDPA, 2023 and applicable RBI data localisation guidelines, ZODIAQ stores all user data — including payment transaction data — on servers located within India. Where limited processing of non-sensitive technical data (e.g., crash logs) occurs on servers outside India through third-party service providers, ZODIAQ ensures that appropriate contractual safeguards are in place, consistent with applicable law.

18. Limitation of Liability & Disclaimer

This Privacy Policy constitutes ZODIAQ's operational commitment to data protection and is published pursuant to applicable Indian law. It does not create any contractual or legal rights in favour of any user beyond those guaranteed by statute.

ZODIAQ makes no warranty that astrological predictions — whether generated by the AI Prediction Engine or provided by astrologers — will be accurate, complete, or applicable to any individual circumstance. Astrological guidance is advisory and entertainment in nature. It does not constitute medical, legal, financial, or psychological advice.

ZODIAQ is not liable for any decisions made by users in reliance on astrological consultations or AI-generated predictions. Users who require professional advice in health, legal, or financial matters are strongly encouraged to consult appropriately qualified professionals.

19. Changes to This Privacy Policy

ZODIAQ may update this Privacy Policy from time to time to reflect changes in applicable law, platform features, or our data practices. Material changes will be notified to users via in-app notification and/or registered email at least 15 days prior to the change taking effect, in accordance with the DPDPA, 2023.

The "Last Reviewed" date at the top of this document will be updated with each revision. Continued use of ZODIAQ after the effective date of any updated Policy constitutes your acceptance of the revised terms.

20. Governing Law and Jurisdiction

This Privacy Policy shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000; the SPDI Rules, 2011; and the Digital Personal Data Protection Act, 2023.

Any dispute arising under or in connection with this Policy shall be subject to the exclusive jurisdiction of the competent courts at [City of Registered Office, India].

By registering on and using the ZODIAQ platform, you confirm that you have read, understood, and agree to be bound by this Privacy Policy, including the processing of your Sensitive Personal Data or Information as described herein.
